GENERAL SALES CONDITIONS
The following Sales Conditions aim to clarify the relationships between the Company L’EPICURIEN S.A.S. based ZA La Méridienne 34700 Le Bosc France - Social Capital 152 449 €, registered in Clermont L’Hérault under the number 353 292 782, TVA number FR 01353292782 and the customer using the website www.epicurien.com.
The sales of our company are governed by the present general sales conditions, which prevail over any purchase conditions, except formal and express infringement of the seller. Buyer recognizes to have acquainted with these general sales conditions and accepts them as being part of the aforementioned contract.
PRODUCT CHARACTERISTICS
The goods to be sold are only the ones which appear on the webshop. The company reserves the right to reduce or to cancel part of an order according to his stock position. For the promotional operations, the company declines any responsibility in case of disregard in the order of the validity dates or the available quantities. Pictures are presenting to give to customers the best possible appreciation of the products. Therefore, the company denies any responsibility if some difference specifically in terms of colour may appear at the reception of the order.
PRICING AND EXECUTION OF THE ORDER
Invoices will be confirmed according to the prices indicated on the webshop. The order can be considered as valid when the customer receives the proper confirmation. The customer who wants to deliver the goods abroad has to take contact with the export department of the company L’EPICURIEN. This one will make a shipping proposal before sending any confirmation. All specific custom obligations (duties, forms…) will stay under the customer responsibility.
DELAYS - DELIVERY
The delivery periods are given only as a rough guide. The buyer can not seek from any compensation nor justify a cancellation of the order in case of delay in delivery independent from the will of the consecutive seller notably by lack of raw materials or other indispensable supplies, machines breakdown, either any act of God called by the seller and or the transport company in charge of the delivery.
CLAIMS
To be considered, reserves and claims regarding the quality or quantities should be mentioned on transport receipt and a copy should be sent by registered letter in 4 days following the delivery. Returns of goods are liable to L’EPICURIEN previous agreement and by the carrier which delivered the goods. The non-observance of these conditions will entail the refusal to sign for the wares returned.
RETRACTATION RIGHT
According to the article L121-20 of the French Consumption Right, the buyer has 7 days to return to his costs the full order to the condition that the goods are in perfect original statement and enclosed with the invoice. Any damaged product will be nor exchange nor refund.
PROTECTION OF THE INFORMATION
All information given by the customer will be used only by L’EPICURIEN for the delivery of the order and the security of the payment. According to the legislation 78-17 from the 6th of January 1978, modified on the 6th of august 1984, the customer has the right to access, to modify or to cancel all information given. To perform this right he has only to contact the customer service of L’EPICURIEN ZA La Méridienne 34700 Le Bosc France.
CONTESTINGS
All our products are conformed to the European Regulation. It is to the responsibility of the buyer who has decided to export these goods to check with the local regulation that everything is conformed. L’EPICURIEN will deny any responsibility if any trouble occurs during the custom procedure.
Any claim relative to the issue, interpretation or performance of the contract governed by the present Sales Conditions in pursuance of the French Law, will come under the jurisdiction of the Commercial Court of Clermont L’Herault (34 France), this proceeding is expressly accepted by the buyer.
